Terms and conditions

1. Definitions

 

TThe following general terms and conditions will apply to all sales of goods by CampMap by CicoBella șand its partners, through the online store www.cicobella.ro to the Buyer, and may be modified at any time by CampMap by CicoBella without prior notice.

 

Thus, the following terms shall mean:

Buyer – a privat person / legal entity or other legal entity placing an Order.

Seller – CampMap by CicoBella, trading under the business name SEBASTIEN DANIEL GUI INDIVIDUAL ENTERPRISE, with its registered office at Vasile Alecsandri 45a 907160, VAT ID 47926904, registration number in the Trade Register F13/365/2023.

Goods – any product, including documents and services mentioned in the Order, to be supplied by the Seller to the Buyer.

Order – an electronic document serving as a means of communication between the Seller and the Buyer, through which the Seller agrees to deliver the Goods, and the Buyer agrees to receive these Goods and make payment for them.

Contract – an Order confirmed by the Seller.

Intellectual Property Rights – tall immaterial rights such as know-how, copyright and related rights, database rights, design rights, model rights, patents, registered trademarks, and domain name registrations for any of the above.

Site – the domain www.cicobella.ro nd its subdomains.

 

2.  Contractual Documents

By placing an electronic Order on the website www.cicobella.ro, the Buyer agrees to the form of communication (email, phone) through which the Seller conducts its operations. The Order will consist of the following documents:

The Order (together with clear mentions regarding delivery and billing details) and its specific conditions.

Terms and Conditions

If the Seller confirms the Order, this implies a complete acceptance of the Order's terms. Acceptance of the Order by the Seller is considered finalized when there is an electronic confirmation (email) from the Seller to the Buyer, without requiring an acknowledgment of receipt from the Buyer. The Seller does not consider an unconfirmed order to have the value of a Contract at any time.
Order confirmation is done electronically (via email). The prices of the products in the order are valid for 3 working days from the date of order registration. The general terms and conditions of sale will form the basis of the Contract thus concluded.

3. Seller's Obligations

The Seller will use their professional and technical knowledge to achieve the result stipulated in the Order and will deliver the Goods that meet the Buyer's requirements and specifications as expressed in the Order.

 

The information presented on the Seller's websites is for informational purposes and may be modified by the Seller without prior notice. Product descriptions may be incomplete, but the Seller makes efforts to provide the most relevant information to ensure that the product is used within the parameters for which it was purchased.

  

4. Intellectual and Industrial Property Rights

The User/Buyer understands intellectual property rights and will not disclose to any third party or make public any of the information received from the Seller.

All designs, graphic elements, and designs appearing on the website, the website name, and graphic symbols are registered trademarks owned by CampMap by CicoBella and cannot be taken, copied, or used without the written consent of the owner.

 

All content elements, such as descriptions, designs, graphic elements, and designs appearing on the website, including but not limited to logos, stylized representations, trademarks, static images, dynamic images, text, and/or multimedia content presented on the site, are the exclusive property of CampMap by CicoBella. All rights obtained in this regard, directly or indirectly through usage and/or publication licenses, are reserved.

 

The User/Buyer is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content element mentioned above in any context other than the originally intended one by CampMap by CicoBella, include any content element outside the Site, remove copyright marks from CampMap by CicoBella indicating copyright over content elements, and participate in the transfer, sale, distribution of materials made by reproducing, modifying, or displaying content elements without the express written consent of CampMap by CicoBella.

 

5. Rights to Website Content

The entire content of the website and graphic elements, including but not limited to all textual content, as well as the technical sources of all present and future services and facilities—except when expressly stated otherwise—sources of the pages and any other material transmitted in any form to Users (through direct viewing on the site, newsletters, etc.) belong to CampMap by CicoBella.

The content of the website, regardless of its location on the site and its type, may be used exclusively for personal purposes. Any use of content by third parties for purposes other than personal use may only be done with the prior written consent of CampMap by CicoBella. Therefore, copying, taking, reproducing, publishing, transmitting, selling, partially or wholly distributing or modifying the content of this site, or any part thereof, for purposes other than personal use, is prohibited, with the following exceptions:

 

(i) Reproduction (on non-commercial websites, forums, press articles, etc.) of small excerpts from published articles (max. 400 characters) is allowed, provided that the source of the information taken is specified with a link, as follows: (Source: website name - link to the website's content).

(ii) Links to the website www.cicobella.ro are permitted, and the source of the information should be specified after each link or at the end of the article, as follows: "Information provided courtesy of CampMap by CicoBella - link to the website's content).

 

Users are obligated to respect all copyright and related rights, as well as any other intellectual property rights that the website Administrator and its partners hold in connection with the website www.cicobella.ro.

CampMap by CicoBella reserves the right to take legal action against any individual and/or entity that violates the above provisions. Requests for the use of website content for purposes other than personal may be made by email to the address mail@CampMap by CicoBella.ro, specifying "Attention: agency".

 

Anyone who transmits or publishes information or materials to the website in any way undertakes not to prejudice in any way the copyright that a third party could invoke in connection with the materials and information transmitted in any way to the website. Persons who send information or materials in any way understand and accept that any violation of this obligation cannot in any way engage the responsibility of CampMap by CicoBella, but only the responsibility of the respective individuals.

 

CampMap by CicoBella may carry out advertising campaigns and/or promotions at any time in any section of the site, without requiring the Users of the site to provide their consent. The spaces and size of advertising campaigns and promotions do not require the consent of the Users of the site and can be changed at any time without prior notice.

CampMap by CicoBella does not assume responsibility for damages or losses resulting from advertising campaigns or promotions organized on the site, other than those organized strictly on the site.

 

 

6. Limitation of the Administrator's Liability

CampMap by CicoBella does not assume the obligation and does not guarantee implicitly or explicitly for the content of the site, respectively for the content provided by its partners or the Users of the site. However, CampMap by CicoBella will make all reasonable efforts to ensure the accuracy and professional manner in which the information on the site will be provided, to gain and maintain the trust of the Users of the site. In this regard, CampMap by CicoBella will try to correct errors and omissions as soon as possible.

 

The website administrator does not provide any warranties for the content of the site, and in no situation can be held responsible for any loss or damage that may result from the use of any part/sequence/page of the site or from the inability to use it, regardless of the cause or misinterpretation of any provisions of the site's content.

The information provided through the website is offered in good faith, from sources deemed reliable. In case any of the published articles or any other information falls under copyright law, we kindly ask users to contact us at the email address [email protected] to take the necessary measures. Furthermore, users should be aware that the presented information may include possible inaccuracies (e.g., technical data or typing errors). that the services available through the site will function continuously, without interruption, without errors - regarding this aspect, CampMap by CicoBella does not assume responsibility for any damages that users may have due to the temporary or defective malfunctioning of the site or for the use of information obtained by using the links from the site to other websites (their use is at the discretion of the users).

 

Furthermore, users understand and accept that CampMap by CicoBella is absolved of any responsibility for advertising messages posted on the site or through the services offered by the site, as well as for the goods or services provided by the authors of these advertising messages.

 

Expressly, users of the site agree to absolve CampMap by CicoBella from any judicial or extrajudicial action that arises as a result of incorrect or fraudulent use of the site.

 

For cases of force majeure, CampMap by CicoBella and/or its operators, directors, employees, branches, subsidiaries, and representatives are entirely exempt from any liability. Force majeure cases include, but are not limited to, technical equipment malfunctions of CampMap by CicoBella, lack of internet connectivity, lack of telephone connectivity, computer viruses, unauthorized access to the Site's systems, operational errors, etc.

 

Users agree to protect and indemnify CampMap by CicoBella and/or its operators, directors, employees, branches, subsidiaries, and representatives against any claims, demands, actions, impositions, losses, damages, costs (including, without limitation, attorney's fees), expenses, judgments, decisions, fines, settlements, or other obligations arising from or related to any other action of the Users in connection with the use of the website or the services offered through it.

 

CampMap by CicoBella does not offer any warranty, either expressly or implicitly, regarding, but not limited to, the operation of the website www.cicobella.ro, the information, content, materials, or products on the site, as well as their suitability for a particular purpose.

 

Users expressly agree that the use of this site and the application of the information is done at their own risk.

  

7. Subscribing Users to Newsletters and Alerts

Users of the website have the option to receive newsletters and alerts via email, with the possibility for Users to opt-out at any time from receiving such notifications with a single click on the unsubscribe link in the newsletter/alert received at the explicitly provided email address during the subscription.

 

Considering that access to the products offered through the website is done through an active account, based on a username and password, we recommend that Users do not disclose these elements to third parties, even if they claim to be contacting you on behalf of the website.

9. Billing and Payments

 

The price, payment method, and payment term are specified in the Order. The Seller will issue an invoice for the Goods delivered, and the Buyer's obligation is to provide all the necessary information for the invoice issuance in accordance with the applicable law.

For the correct communication of the invoice related to the Order, the Buyer has the obligation to update, whenever necessary, the data from their Account and access the information and documents related to each existing Order in the Account.

By placing the Order, the Buyer agrees to receive invoices in electronic format via email, at the email address mentioned in their Account.

 

10.  Responsibilities

• The Seller is obliged to ship the Goods and Services by door-to-door courier to the Buyer.
• The Seller releases itself from the risks and responsibilities associated with the Goods and Services at the moment of their delivery to the internal courier company collaborating with the Seller or to the Buyer's representative.
• The Seller will ensure proper packaging of the Goods and Services and will ensure the transmission of accompanying documents.
• The Seller cannot be held responsible for any damages suffered by the Buyer or any third party as a result of the Seller's fulfillment of any of its obligations according to the Order and for damages resulting from the use of the Goods after delivery, especially for product loss. The Seller will be liable in case subcontractors and/or partners of any kind involved in the execution of the Order fail to fulfill any contractual obligations.
• The Seller does not assume responsibility for the product descriptions presented on the site. The images are presented on the site as an example, and the delivered products may differ from the images and descriptions displayed on the site in any way due to changes in characteristics and design without prior notice. The Seller reserves the right to supplement and modify any information on the site without prior notice.
• The Seller does not guarantee the availability of products in stock, which is why it has the right not to partially or completely deliver a certain order if certain products are no longer in the current offer or are unavailable.
• In case prices or other product details have been displayed incorrectly, including due to incorrect entry into the database, the Seller reserves the right to cancel the delivery of the respective product and to notify the customer as soon as possible about the error if the delivery has not yet been made.
• The Seller is not responsible for damages caused by the malfunctioning of the website or for those resulting from the impossibility of accessing certain links published on the site.
• The maximum value of the Seller's obligations towards any customer in the case of non-delivery or improper delivery is the value of the amounts collected by the Seller from that customer.
• The products sold on the site are intended for personal use, and their resale is strictly prohibited, in accordance with the Fiscal Code.

 

11.  Delivery of Products

 

• Delivery is not free and is done through a rapid courier service as described in the "Delivery" section.
• Our products are sometimes made to order, which means that the production and delivery time can be up to 14 working days starting from the day the order is processed.
• Orders are processed as soon as possible after placement, within the hours of Monday - Friday 10:00-18:00. In the case of orders placed outside of business hours (Monday - Friday 10:00-18:00) or on weekends, they will be processed on the next business day. During holidays and discount periods, the delivery time may be extended.
• If the package cannot be delivered (recipient does not respond, the address you provided is incorrect, etc.), you will be contacted by phone by the courier. If the recipient cannot be contacted, the parcels remain with the regional courier for 7 days, after which they return to the Sender.
• We are not responsible for delayed shipments, loss, damage, non-delivery, or incorrect delivery of a shipment or any part thereof if they are caused by the following situations/circumstances beyond our control, including but not limited to:
• roadblocks (fallen trees, rocks, chain collisions), landslides near the road;
• bridge collapses, mountain tunnel blockages, train derailments near the road, natural blockades, unauthorized strikes, spontaneous regional riots, adverse weather conditions that are unfavorable for the proposed itinerary;

• Natural causes: earthquakes, cataclysms, devastating storms, tornadoes, wildfires, floods, river overflows, riverbed abandonments, etc;
• Human causes: state of war, state of siege, forced nationalization (transfer to state ownership), revolutions, popular uprisings, etc;
• Non-compliance with orders by suppliers and third parties.

 

12. Acceptance

Acceptance will be made when the Goods conform to the technical specifications mentioned in the Order. In the event that the Buyer discovers that the delivered Products do not conform to the technical specifications, the Seller will bring the Products into conformity. Additionally, for products sold and delivered by CampMap by CicoBella, the Buyer is entitled to return the products within 14 days.

 

13. Transfer of Ownership

Ownership of the Goods will be transferred upon delivery, after payment is made by the Buyer at the location specified in the order (understanding delivery as the signing of the transport document provided by the courier or signing of the receipt on the tax invoice in the case of deliveries made by the Seller's staff). In the case of delivery by courier, the courier is not authorized by the Seller to allow the Buyer to open the packages before signing for delivery, only after signing for delivery and payment of any applicable charges.

 

14. Return of Products

The Buyer can request the return of products in the following situations:

The packages show severe damage;

Products have been delivered / invoiced incorrectly. Delivery of other products than those requested must be reported immediately. The Buyer can request the return of these for replacement, and if the product is no longer in stock, can opt for replacement or a full refund. If agreed upon replacement with a higher value product, the Buyer will pay the difference, and if the value is lower, they will receive a partial refund up to the value of the replacement product. Return and transportation costs for the replacement product, if applicable, are borne by the customer.

The products have manufacturing defects;

The Buyer has the right to notify the Seller in writing that they are renouncing the purchase, without penalties and without citing a reason, within 14 days of receiving the product. Additionally, in accordance with art. 7 para. 1 of O.G. 130/2000, the Buyer has the right to unilaterally terminate the distance contract in writing within 14 days of receiving the product/products, without penalties and without citing any reason. In this case, the direct costs of returning the products will be borne by the Buyer in accordance with the law.

The products must be returned in their original packaging, with the invoice attached, and must not show signs of physical wear or damage.

Customized products cannot be returned. Please note that these products are created based on your specified configurations and cannot be changed or returned.

If agreed upon replacement with a higher value product, the Buyer will pay the difference, and if the value is lower, they will receive a partial refund up to the value of the replacement product. Return and transportation costs for the replacement product, if applicable, are borne by the Buyer. In the event that the products requested for return have damaged or incomplete packaging, signs of wear, scratches, or damage, we reserve the right to decide whether to accept the return or to withhold an amount, which will be communicated after assessing the damages.

In the case of exercising the legal right to return the product, the refund of its value will be made by bank transfer to the account specified by the Buyer within a maximum of 14 days of receiving the returned product.

 

15. Processing of Personal Data

To ensure compliance with the right to the protection of personal data of the website users, we have implemented specific protection measures, taking into account Romanian legislation, as well as the requirements set out in Regulation (EU) 2017/679 - applicable throughout the European Union as of May 25, 2018 ("the Regulation").

Personal data represents any information through which you can be identified, especially by an identifier such as a name, an identification number, location data, an online identifier, or one or more factors related to your physical, physiological, genetic, mental, economic, cultural, or social identity.

Our company takes all necessary measures to ensure compliance with your right to the protection of personal data, and these terms represent a notice established by Articles 13 or 14 of the Regulation, in which we explain why we collect your personal data, how we protect this data, and what your rights are regarding this data collection.

We encourage you to carefully read the document and request any additional information or clarification you deem necessary regarding the content of this notice.

 

I. General considerations regarding your personal data

 

In accordance with Regulation (EU) 2017/679, CampMap by CicoBella will safely manage and only for the specified purposes the personal data provided by Users. Users are informed through the Terms and Conditions that the personal data they provide will be processed for the purpose of providing optimal internet services, providing goods and services, advertising, marketing, and statistics services by CampMap by CicoBella. CampMap by CicoBella carries out the following processing operations: collection, recording, organization, storage, adaptation, modification, extraction, consultation, use, and, in some cases, transmission to third parties, exclusively and regulated based on a commercial contract that ensures the security and confidentiality of data, as well as the respect of user rights, the personal data of website Users for the administration, maintenance, improvement, and obtaining information about the services it offers, as well as to prevent errors and information leaks through its own IT network, breaches of the law, or contractual terms.

The personal data to be collected may be used, including by automatic profiling (for those Users who have given explicit consent) and for personalizing the services offered to Users through the website to the greatest extent possible, as well as for marketing purposes. Automatic profiling will not target minors, and their personal data will not be processed for this purpose.

Users will provide their personal data at their own discretion when creating a valid account on the website or subscribing to a service available on the website to benefit from the services and products offered through it. Upon registration on the site, Users are required to provide certain personal data, such as name, gender, date of birth, email address, phone number, profession, habits/preferences/behavior, as well as other personal information.

The User is solely responsible for all data provided when creating a user account on the website. To confirm the data and the account, the User will be notified at the email address provided when creating the account. This confirmation email is intended to stop fraudulent actions by users who use the email addresses of other people to create fictitious accounts. If you receive such a message, under the conditions in which you have not personally registered on the site, please send us an email at [email protected] to delete the respective account within a maximum of 3 working days. The email will contain, in pdf format, the current version of this Contract.

The User's profile form contains fields that can be edited if it is desired to modify or complete the data provided when creating the account.

The User is not obligated to provide this data, as it is necessary for (i) keeping records of website usage and (ii) providing the services through the website optimally, for making promotional campaigns known, for advertising purposes, for personalized marketing and advertising actions, and for the User's access to additional facilities. The User's refusal to provide the requested data will result in non-participation in promotional activities organized through the website and the non-use of additional services offered exclusively to Users with an account on this website.

The website can be used even if the User decides not to create a profile by providing personal data, with the exceptions set out in the Cookies Policy (an integral part of this Contract).

According to Regulation (EU) 2017/679 and Law no. 677/2001, Users have the right of access, intervention on data, the right not to be subject to an individual decision, and the right to appeal to the court. At the same time, Users have the right to object to the processing of their personal data and to request the deletion of data.

To exercise these rights, Users can submit a written request in this regard, which they will send by email to [email protected] with the specification "Request for personal data."

The website undertakes not to send spam messages (commercial messages for which it does not have the explicit prior consent of the User) and to take all technically feasible measures to ensure the security and confidentiality of user data.

The website reserves the right to delete, without prior notice, the accounts and access of members who violate the Terms and Conditions, who engage in proven fraudulent activities, defamation, or attacks on the security and confidentiality of information within the website or the operating company of the website.

 

II. Personal data that we collect, grounds for collection, and purposes of collection

 

Within the online communication relationship established between the website and the user, we collect and process your personal data, and the collection and processing of this data are necessary for providing informative and promotional content to the user, following the completion, by the user, of personal data in a voluntary manner, within the website, by accessing one or more of the sections: create an account, update an account, subscribe to the newsletter, complete an online questionnaire, complete an online form, for obtaining personalized information or commercial benefits, within the campaigns promoted on the website.

The grounds for collecting personal data on the website can be the following:

In the enumerations below, we present in detail what personal data is collected, as well as the grounds, purposes, and duration of their collection. Providing the data indicated below is not mandatory for viewing the Website, except for those related to Cookies.

The provided data is necessary only to deliver specific services to the Users who submit them.

Within the secure database, until the explicit request for deletion by the user or up to 10 years from the user's last activity on the site. After these 10 years, the data will be anonymized electronic.

In order to ensure the user's right to protection regarding the processing of personal data, we implement special technical and organizational measures to safeguard certain categories of sensitive data or data capable of significantly affecting rights.

Utilizatorul are dreptul de a obține accesul la datele sale cu caracter personal pe care le prelucrăm, precum și dreptul de a obține copii ale acestora. 16 Force Majeure

This contract is subject to Romanian law. Any disputes between CampMap by CicoBella and users/customers/buyers shall be resolved amicably, or, if this is not possible, the disputes shall be settled by the competent Romanian courts.

19. Modification of Terms and Conditions
